These Terms of Service ("Terms") form a legally binding agreement between you and Lior Ben Chetrit ("Operator", "we", "us", or "our") governing your access to and use of Kana Daily (the "Service"). By accessing or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.
Kana Daily is a web application for learning Japanese kana (Hiragana and Katakana), including flashcard lessons, quiz exercises, stroke order practice, spaced repetition review, and related study tools. The Service is operated by Lior Ben Chetrit, an individual developer.
The Service is provided as-is and may be updated, modified, or discontinued at any time. Features, pricing, and availability may change without prior notice, except where required by law.
You must be at least 13 years old to use Kana Daily. If you are between 13 and 18 (or the age of majority in your jurisdiction, whichever is higher), you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.
We do not knowingly permit children under 13 to use the Service. If we discover that a user is under 13, we will terminate their account and delete their data.
By using the Service, you represent and warrant that:
You may use Kana Daily as a guest (no account required) or create an account for progress sync across devices and social features. You may register using an email address and password, a Google account, or a magic link sent to your email.
You agree to provide accurate, current, and complete information when creating your account and to keep this information up to date. Do not use misleading information or impersonate another person.

We are not liable for any loss or damage arising from your failure to maintain account security. You may not share your account with others or transfer your account to another person.
Each person may maintain one account. Creating multiple accounts to circumvent suspensions, bans, or feature restrictions is prohibited and may result in termination of all associated accounts.
You may delete your account at any time from the Progress page in the app. Account deletion is permanent and irreversible. All associated data will be deleted from our servers within 30 days of the deletion request (see our Privacy Policy).
You agree to use Kana Daily only for lawful purposes and in accordance with these Terms. You agree not to:
We reserve the right to investigate suspected violations and to suspend or terminate accounts that violate this policy, without notice where necessary to protect the Service or other users.
Kana Daily and all content, features, and functionality of the Service - including but not limited to the software code, design, graphics, lesson content, quiz questions, scoring algorithms, user interface, and text - are owned by Lior Ben Chetrit and are protected by applicable intellectual property laws. You may not copy, reproduce, distribute, modify, create derivative works of, publicly display, or exploit any part of the Service for commercial purposes without our prior written consent.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial educational purposes.
The stroke order paths used in the writing practice feature are derived from the KanjiVG dataset, which is licensed under the Creative Commons Attribution-ShareAlike 3.0 Unported (CC BY-SA 3.0) license, © Ulrich Apel. In accordance with that license, any redistribution of the stroke data in derivative works must also be licensed under CC BY-SA 3.0 and must provide appropriate attribution. If you submit feedback, suggestions, or ideas about the Service, you grant us a perpetual, royalty-free, worldwide license to use, incorporate, and implement that feedback in the Service without any obligation to compensate you.
"Kana Daily" and any associated logos are trademarks of Lior Ben Chetrit. You may not use these marks without our prior written permission.
The Service allows you to provide certain user-generated content ("UGC"), including your display name and any content shared through friend or social features.
You are solely responsible for any UGC you submit and represent that:
By submitting UGC (such as a display name visible to other users), you grant us a non-exclusive, worldwide, royalty-free license to use, display, and reproduce that UGC within the Service solely for the purpose of operating and providing the Service to you and other users.
We reserve the right (but have no obligation) to review, moderate, or remove any UGC that violates these Terms or that we determine, in our sole discretion, is harmful to the Service or other users. Repeated violations may result in account termination.
Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information and is incorporated into these Terms by reference. By using the Service, you agree to the practices described in the Privacy Policy.
The free tier of Kana Daily displays advertisements served by Google AdSense and potentially other advertising partners. We are not responsible for the content of third-party advertisements. The presence of an advertisement does not constitute an endorsement by us of the advertised product or service.
Premium subscribers do not see advertisements. See our Privacy Policy - Advertising section for information about behavioral advertising and your opt-out options.

Kana Daily is an educational tool. We make no guarantees that use of the Service will result in any specific language learning outcome. Learning results depend on individual effort, study habits, and many other factors outside our control.
Some jurisdictions do not allow the exclusion of implied warranties. In such cases, the above exclusions apply to the fullest extent permitted by applicable law.

Our total cumulative liability to you for all claims arising out of or relating to these Terms or the Service, whether in contract, tort, or otherwise, shall not exceed the greater of (a) the total amount you paid us for Premium subscriptions in the twelve (12) months immediately preceding the claim, or (b) USD $50.
The limitations of liability in this section reflect a reasonable allocation of risk between you and us and are a fundamental element of the basis of the bargain between you and us. Some jurisdictions do not allow certain limitations of liability; in such cases the limitations apply to the maximum extent permitted by applicable law.
Nothing in these Terms excludes or limits our liability for fraud, fraudulent misrepresentation, death or personal injury caused by our negligence, or any other liability that cannot be excluded or limited by applicable law.
You agree to defend, indemnify, and hold harmless Lior Ben Chetrit and any associated parties from and against any claims, liabilities, damages, judgments, awards, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to:
We reserve the right to assume exclusive control of the defense of any matter subject to indemnification by you, at your expense, and you agree to cooperate with our defense of such claims.
You may stop using the Service at any time. If you have an account, you may delete it from the Progress page in the app. Cancellation of a Premium subscription is separate from account deletion (see Section 5).
We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including but not limited to:
In cases of serious violations (e.g., illegal activity, harassment), we may terminate your account without prior notice and without refund.
We reserve the right to discontinue the Service, in whole or in part, at any time. If we discontinue the Service permanently while you have an active paid Premium subscription, we will provide a pro-rated refund for the unused portion of your billing period.
Upon termination, your right to use the Service immediately ceases. Sections of these Terms that by their nature should survive termination (including intellectual property, limitation of liability, indemnification, and dispute resolution) shall survive.
Before filing any formal claim, you agree to contact us at kanadailysupport@gmail.com and give us a reasonable opportunity (at least 30 days) to resolve the dispute informally. Many concerns can be resolved quickly this way.
Nothing in these Terms limits your rights as a consumer under the mandatory laws of your country of residence. If you are an EU or UK consumer, you may have additional rights under consumer protection law that cannot be waived by contract, including the right to bring proceedings in the courts of your country of residence.

These Terms are governed by general principles of international commercial law to the extent possible. Given that Kana Daily serves users worldwide, we have not designated a single mandatory governing jurisdiction for all users, and do not seek to deprive you of the protection of the mandatory consumer protection laws of your country of residence.
If a dispute arises that cannot be resolved informally, the parties agree to attempt to resolve it in a mutually agreeable forum, taking into account the user's location and applicable consumer protection laws. Nothing herein prevents you from seeking legal remedies in the courts of your jurisdiction as permitted by applicable law.
We reserve the right to modify these Terms at any time. When we make material changes, we will:

For free users, continued use after notice of material changes constitutes acceptance. For Premium subscribers, we will seek your explicit re-acceptance for changes that materially alter your subscription rights or increase your fees.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the Service and supersede all prior agreements and understandings relating to the subject matter hereof.

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, internet outages, governmental actions, or third-party service failures.
